These Terms and Conditions apply to purchases made through the éepa coffee online store.

2. Scope
These Terms and Conditions apply to contracts concluded between éepa coffee and customers through our online store.
A consumer is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business or profession.
Mandatory consumer protection rights under applicable law remain unaffected.
3. Products
We sell coffee and related products through our online store.
The essential characteristics of each product are described on the respective product page.
Product images are provided for illustrative purposes. Minor differences in appearance, colour or packaging may occur and do not constitute a defect where they do not materially affect the characteristics or quality of the product.
4. Prices
All prices displayed in the online store are stated in euros (EUR).
The applicable price is the price displayed at the time the order is placed.
Any applicable taxes are included in the displayed price unless expressly stated otherwise.
Shipping costs, where applicable, are shown separately before the customer submits the order.
5. Ordering and Conclusion of Contract
The presentation of products in our online store does not by itself constitute a legally binding offer.
Customers may select products, add them to the shopping cart and proceed through the checkout process.
Before submitting an order, customers have the opportunity to review the products selected, quantities, delivery information, total price and any applicable shipping costs and to correct input errors.
By submitting an order through the checkout function that clearly indicates an obligation to pay, the customer submits a binding offer to purchase the products contained in the order.
After the order has been submitted, the customer will receive an electronic order confirmation.
The contract is concluded when we accept the order, including by expressly confirming the order, confirming shipment or otherwise commencing fulfilment of the order.
We reserve the right to reject an order where there is a legitimate reason to do so, for example where a product is unavailable, payment cannot be authorised or the delivery information provided is incomplete or invalid.
6. Payment
Available payment methods are displayed during checkout.
Payments are processed through Stripe and payment methods made available through Stripe.
Depending on availability and the customer's location or device, payment methods may include payment cards and other payment services supported by Stripe.
The customer must provide accurate and complete payment information.
Payment processing is subject to the conditions of the respective payment service provider.
We do not store complete payment card details.
7. Delivery
Delivery is made to the delivery address provided by the customer during checkout.
Available delivery destinations, shipping methods, shipping costs and estimated delivery times are displayed in the online store or during checkout before the order is submitted.
We may use a shipping or delivery service provider selected by éepa coffee to fulfil the order.
Delivery times stated in the online store are estimates unless a specific binding delivery date has expressly been agreed.
If delivery is delayed due to circumstances beyond our reasonable control, we will inform the customer where appropriate.
Mandatory statutory rights relating to delayed delivery remain unaffected.
Where applicable and available, information about environmentally friendly delivery options will be displayed during the ordering process.
8. Transfer of Risk
For contracts with consumers, the risk of accidental loss or damage to the goods generally passes to the customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods.
Mandatory statutory provisions remain unaffected.
9. Right of Withdrawal
Consumers may have a statutory right to withdraw from a distance contract in accordance with applicable Austrian and EU consumer protection law.
Detailed information concerning the existence, conditions, time limits, procedure and any applicable exceptions to the right of withdrawal is provided separately in our Right of Withdrawal / Cancellation Policy.
For certain goods, the statutory right of withdrawal may be excluded or may cease to apply under circumstances provided by law.
This may be particularly relevant for certain sealed goods which are not suitable for return for health protection or hygiene reasons once the seal has been removed, as well as other categories of goods for which statutory exceptions apply.
Nothing in these Terms and Conditions limits any mandatory withdrawal rights granted to consumers by law.
10. Returns and Refunds
Where a customer validly exercises a statutory right of withdrawal, any return and refund will be handled in accordance with our Right of Withdrawal / Cancellation Policy and applicable law.
This does not affect the customer's statutory rights in relation to defective or non-conforming goods.
Customers should contact us at eepamoment@gmail.com regarding returns, damaged products or incorrect deliveries.
11. Damaged, Incorrect or Defective Products
Customers are requested to contact us as soon as reasonably possible if an order arrives damaged, contains an incorrect product or appears to be defective.
Where possible, customers should provide the order number and relevant information or photographs that allow us to assess the issue.
This request does not limit or condition the customer's statutory rights.
12. Statutory Conformity and Warranty Rights
Consumers have statutory rights where goods do not conform to the contract.
These statutory rights are not restricted by these Terms and Conditions.
Information concerning the applicable statutory conformity rights is provided in accordance with the mandatory consumer information requirements applicable to our online store.
Any voluntary commercial guarantee offered for a particular product, if applicable, does not limit the customer's statutory rights.
13. Product Availability
Products are offered subject to availability.
If a product becomes unavailable after an order has been placed and we are unable to fulfil the order, we will inform the customer and refund any amount already paid for the unavailable product where required.
14. Customer Information
Customers are responsible for providing complete and accurate information when placing an order, particularly their name, delivery address, email address and any other information necessary for fulfilment.
If incorrect information supplied by the customer prevents or materially delays delivery, additional costs resulting from a new delivery attempt may be charged where permitted by law and where the customer is responsible for those costs.

16. Liability
We are liable in accordance with applicable statutory provisions.
Nothing in these Terms and Conditions excludes or restricts liability where such exclusion or restriction is prohibited by law, including mandatory consumer protection provisions.
17. Intellectual Property
Unless otherwise stated, the content of the éepa coffee website, including text, photographs, graphics, branding and other original content, is protected by applicable intellectual property laws.
Use beyond what is permitted by law requires the consent of the respective rights holder.
18. Data Protection
Personal data is processed in accordance with applicable data protection law and our Privacy Policy.
Information concerning the processing of personal data by éepa coffee, Hostinger, Stripe and other relevant service providers can be found in our Privacy Policy.
19. Applicable Law
These Terms and Conditions and contracts concluded through our online store are governed by Austrian law.
Where the customer is a consumer, this choice of law does not deprive the customer of mandatory consumer protection rights that apply under the law of the country in which the customer has their habitual residence, where such protections are applicable.
20. Severability
If any provision of these Terms and Conditions is invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by law.
Mandatory statutory provisions apply in place of any invalid or unenforceable provision.
